Legal guardianship
An unaccompanied minor below the age of 18 will require a legal guardian (Obsorgeberechtigter) in order to get a student residence permit for Austria.
What is the process of arranging legal guardianship for an unaccompanied minor to attend school in Vienna?
The process is relatively simple:
- First you find an adult person with residency in Austria willing to act as legal guardian (Obsorgeberechtigter in German).
- Then you sign a contract with the legal guardian bestowing them with guardianship over your child.
We typically suggest signing two contracts: One official one in German that is accepted by the authorities, housing, banks, fitness studios, etc. and another one where parties can set out certain roles and responsibilities of the guardian, fees (if any) for the guardian, limitations of liability for the guardian, reimbursements for the guardian, etc.
We draw up these documents for you and help you find a legal guardian to represent your child in Austria.
